SWFL Bounce House Bros LLC - Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement**PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS.**In consideration of being permitted to use the bounce houses and other inflatable equipment (hereinafter collectively referred to as "Equipment") provided by SWFL Bounce House Bros LLC (hereinafter "the Company"), I, the undersigned participant, or the parent/legal guardian of the minor participant(s) listed below, hereby agree to the following terms and conditions:
1. Assumption of Risk
- I understand and acknowledge that the use of bounce houses and inflatable Equipment involves inherent risks, hazards, and dangers, including but not limited to, falls, collisions with other participants, contact with Equipment, minor injuries (e.g., sprains, bruises), more serious injuries (e.g., fractures, concussions), and in rare cases, even death. I understand that these risks cannot be entirely eliminated. I voluntarily assume all risks, known and unknown, associated with the use of the Equipment.
2. Rules and Regulations
- I agree to abide by all rules and regulations established by SWFL Bounce House Bros LLC for the safe use of the Equipment. I understand that failure to follow these rules may result in injury and/or immediate termination of use without refund. These rules include, but are not limited to:* No shoes, sharp objects, or eyeglasses in the bounce house.* No food, drinks, or gum in the bounce house.* No wrestling, rough play, flips, or climbing on walls.* Supervision of children by an adult is required at all times.* Only an appropriate number of participants allowed in the bounce house at one time.* No one over the weight limit allowed on the Equipment.
3. Release of Liability and Waiver of Claims
- I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue SWFL Bounce House Bros LLC, its owners, officers, employees, agents, contractors, and representatives (hereinafter "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or the minor participant(s) while using the Equipment, or while on the premises where the Equipment is located, regardless of whether such loss, damage, or injury is caused by the negligence of the Released Parties or otherwise.
4. Indemnification
- I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with my or the minor participant's use of the Equipment, including any breach of this Agreement or any negligent or willful act or omission by me or the minor participant.
5. Medical Authorization
- In the event of an emergency, I authorize SWFL Bounce House Bros LLC and its representatives to seek and obtain medical attention for me or the minor participant(s), and I agree to be responsible for any and all costs associated with such medical care.
6. Severability
- I agree that if any portion of this Agreement is found to be unenforceable, the remaining portions shall remain in full force and effect.
7. Governing Law
- This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
**I HAVE READ THIS RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, AND I FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE. I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY, AND INTEND BY MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.**
